DUI vs. DWI - Which is Worse?

For most people, there comes a time in life when you are faced with either the much feared DUI, or  the even worse DWI. But what is the difference between the two?

When pitched together as DUI vs. DWI, who wins? In most states nowadays, the list is continuing to become shorter and shorter on the types of defenses that can be successfully used to escape penalization due to these charges. It is therefore important to know the basics of these charges. As the saying goes, prevention is always better than cure. And with DUI and DWIs, there are few cures.

Under influence or while intoxicated

In DUI vs. DWI, DUI stands for driving under the influence, while DWI refers to driving while intoxicated. Both are related to alcohol, but the influence and the intoxication referred to here may include other substances, some of which are legal, and some others which are illegal.

The basic concept that every driver, whether or not intending to drive while under the influence or intoxicated, is that with an application for driving is a sort of consent to having police poke breathalyzers on you whenever you are suspected of driving while under the influence or intoxicated. Resistance in this case is futile, and the best is to know what to opt for between DUI vs. DWI.

Lesser evil

In general, DUI is a lesser evil when compared to DWI. If caught driving and drunk, your best bet is to hope that the breathalyzer test will point out to alcohol levels of only .07 instead of the dreaded .08 blood alcohol concentration which indicates DWI and higher penalties.

When caught by the police, always remember to cooperate as the police actually have the power to either force you into a breathalyzer test or to give a blood sample in a hospital.

Consider the locale

The states where you live in should also be considered, because various states have different codes regarding DUI vs. DWI. In some states, should you be lucky enough to live in these, are more lenient than others. On the other hand, some states will consider the use of doctor-prescribed medication that causes dizziness, whether as an anticipated result or not, as driving under the influence, or worse, driving while intoxicated.

In some other states, such as in Minnesota, there is no DUI vs. DWI because only DWI is used as a term for the police. On the other hand, states such as New Jersey and Virginia give no distinction between DUI and DWI.

Stay safe

It is important to be able to measure which steps should be taken for you to avoid the greater evil in the DUI vs. DWI pair. However, as always, the best habit is to stay safe and to drive while sober. It may not be as fun, but the hospital isn’t either.
